Please read carefully the following terms and conditions which apply to all orders placed through our website, www.taliabyre.com, (the "Website") and form the legal agreement between you and Talia Byre Ltd.

We are Talia Byre Ltd trading as "Talia Byre", a company registered in England and Wales under company number: 12694748. Throughout the Website, the terms “we”, “us” and “our” refer to Talia Byre Ltd.

What are these terms?
These terms and conditions are the terms on which we supply the clothing and accessories available through our Website (the "Products") to you.
How changes can be made TO these terms?

We may revise these Terms at any time by amending this page. We recommend you check this page from time to time to take note of any changes we have made, as they are binding on you if you place an order after such changes have been made.

For the avoidance of doubt, changes to these Terms will not affect any orders placed before those changes were uploaded to our Website.
Minor changes to your order.

We may make minor changes to the Products you order:
- to reflect changes in relevant laws and regulatory requirements, for example, relating to textile labelling, care instructions, or product safety standards; and/or
- to implement minor adjustments to product specifications, such as changes to care labels, sizing tags, or packaging materials.

We will not make any significant changes to the Products you order (such as changes to design, colour, material, or size) without your consent. If we need to make such changes, we will notify you and you may then contact us to end the contract and receive a full refund before the changes take effect.
PLACING AN ORDER
How do I place an order on the Website?
Our Website has been designed with you in mind. We aim to make your shopping experience as simple and secure as possible, but in case you need some help to purchase a Product from our Website, you need to:
- select which Product you are interested in;

once you have decided on a Product, if it is in stock, click "Add to Cart";

click "Cart" at the top right hand corner of the Website, ensure that the selection and quantity is correct, then click "Checkout";

review your order details on the right hand side, where you will be shown a breakdown of the price for your Product(s). Unfortunately, we cannot add Products to your order once it has been placed;

select "Express checkout" if you wish to continue with one of PayPal, Shopify or Google Pay's fast checkout options. Otherwise, provide your email address and shipping information. If you would like to receive news and offers via email, you may indicate this under the email field. If indicated, we will collect and use your data as set out in our Privacy Policy [hyperlink];

review and amend your contact details and shipping address. Once reviewed, select your preferred delivery method;

select "Credit/Debit card" or "Paypal" depending on how you would like to pay, and enter all required payment information. If your billing address is different than your provided shipping address, you may also enter this below your payment details. You will be shown a breakdown of the price and any applicable delivery costs on the right hand side of the page; and

once you are happy that you have entered the correct payment details and have reviewed your order, tick the box indicating your acceptance of these Terms and click "Pay now" to complete your purchase.
- Once we have received your order, we will send you an email confirming your order to the email address you provided. This email will contain your order number and details of your purchase. By sending you this order confirmation email, we accept your order and a legally binding contract is formed between you and us for the supply of the Products detailed in your order. For bespoke or made-to-order Products, additional terms may apply as set out in clause 6 below, and the contract formation process may differ as specified in that clause.

We try to ensure that availability information of the Products on our Website is correct, but sometimes stock can sell out quickly and it is possible that your order may be accepted for a Product that is out of stock. If the Product you are looking to purchase is out of stock, we will inform you as soon as possible and we will provide you with a refund for the unavailable Product as soon as practicable.
What additional terms apply to bespoke and made-to-order Products?

From time to time, we may offer bespoke or made-to-order Products through our Website or by special arrangement. These are Products that are specifically manufactured or customised according to your individual requirements.

For bespoke or made-to-order Products, the contract formation process differs from standard Products. When you place an order for a bespoke Product, we will send you a detailed "Bespoke Order Confirmation" form for you to complete. The contract will only be formed when we send you our signed version of the Bespoke Order Confirmation, confirming the final specifications, price, and estimated delivery time.

Payment for bespoke or made-to-order Products may be required in full or in part before we commence production. The payment terms will be specified in our written acceptance of your order.

Delivery times for bespoke or made-to-order Products will be longer than our standard Products and will be specified in our written acceptance of your order. We will endeavour to meet the estimated delivery time, but this is an estimate only and time shall not be of the essence.

Your statutory cancellation rights under clause 19 do not apply to bespoke or made-to-order Products that have been made to your personal specifications. Once production has commenced, bespoke orders cannot be cancelled unless the Product is faulty or we have made an error in the specifications.
Which methods of payment do you accept?
We currently accept the following payment methods: (i) Visa; (ii) Mastercard; (iii) American Express; (iv) PayPal; and (v) Elo Touch.
Do I Have To Open An Account With TALIA BYRE To Place An Order?
You do not currently need an account to place an order with us, and you can complete your purchase as a guest by simply entering your details when placing your order. We may introduce account functionality on our Website in the future, but this will remain optional for placing orders.
When will i be charged?

The time at which you will be charged for your order will depend on the payment method you selected at checkout. If you choose to pay by card, we will take payment from you immediately when you place your order. If you choose to pay using PayPal, you can choose when you would like to be charged for your order.

If we are unable to take payment from you, we will let you know as soon as possible and you may need to resubmit your order. If we are unable to take payment from you, we are not obliged to fulfil your order.
What should I do if I have made a mistake in my order?

Unfortunately, we are unable to make changes to your order once it has been placed. If you have placed an order for the incorrect Product, you may cancel your order immediately and reorder the correct item. Your statutory cancellation rights and valid periods of cancellation are set out in clause 19 of these Terms.

It is your responsibility to ensure that all information provided regarding your billing address, personal details, delivery address and payment method is correct and accurate.

If we cannot place your order, for example because the payment details you provided were incorrect, we will let you know as soon as possible and ask you to resubmit your order. We are not responsible to you if we cannot place your order due to a mistake made by you.

If we try to deliver your order but cannot due to a mistake made by you (e.g. because you provided an incorrect shipping address) and you have not told us about this mistake by contacting info@taliabyre.com, you may be responsible for any further delivery or storage costs we have to pay and for any loss or damage to the delivered Products.
DISCOUNT CODES
How can I order with a discount code?
If you have a discount code, you must enter it before you proceed to the checkout as you will not be able to apply your discount code once your order is placed. You may only use one discount code per order.
GIFT CARDS
WHAT TERMS APPLY TO GIFT CARDS?

From time to time, we may give you the option to purchase gift cards from the Website.

Any gift cards purchased from our Website will be dispatched immediately after checkout to the designated recipient via email.

If purchasing a gift card for someone else, please ensure that you enter the correct email address for the recipient – we are not responsible for gift cards that are redeemed by someone other than the intended recipient where the email address entered during purchase was incorrect.

Gift cards can be redeemed towards the purchase of any item sold through our Website with the exception of other gift cards and can be used in conjunction with any other valid promotions or discount codes.

If the total value of your order is less than the value of the gift card, your spend will be deducted and the remaining gift card balance will remain available to be redeemed against a future purchase, subject to the 12 month expiry of the card. If your order exceeds the value of the gift card, you can pay the remaining balance using any other payment method currently accepted by us.

If you return or cancel an order where a gift card was used in full payment of the order, then your refund will be credited back to your gift card. There will be no cash refund made.

If you return, part return, or cancel an order where a gift card was used in part payment of the order in conjunction with any other payment method (such as a credit card, debit card or PayPal) we will always refund to the other payment method first and then any excess amount to the gift card.

Gift cards cannot be exchanged for cash.
What happens if a GIFT card gets lost, stolen or deleted?
We are not responsible for lost, stolen or deleted gift cards. We recommend that you write down the gift card code somewhere safe. This will be the code to enter in on the checkout page.
How long will the Gift Card be valid for after purchase?
Gift cards are valid for 12 months after the date of purchase, after which time any remaining credit balance will be cancelled.
OTHER IMPORTANT TERMS APPLY TO OUR CONTRACT
LIMITATION ON OUR LIABILITY

Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:

losses that were not foreseeable to you and us when the contract was formed;

losses that were not caused by any breach on our part;

business losses; or
-
losses to non-consumers.
TRANSFER OF RIGHTS
We may transfer our rights and obligations under these Terms, [our Privacy Policy and Cookie Policy] at any point. You may only transfer your rights or your obligations under these Terms, [our Privacy Policy and Cookie Policy] to another person only if agreed by both parties in writing.
LAW AND JURISDICTION
